Children's Privacy Policy

This Children's Privacy Policy describes our policies and procedures on the collection, use, and disclosure of children's personal information when you use our Services, and tells you and your children about your privacy rights.

Note: This Children's Privacy Policy is designed specifically to meet our obligations under the Children's Online Privacy Protection Act ("COPPA") with respect to personal information we collect from or about children under 13 through connected devices such as Bear. It applies alongside, and does not replace, our general Privacy Policy, which describes how we collect, use, and disclose personal information about parents and other adult account holders — including when a parent creates an account and registers a connected device. Where this Children's Privacy Policy addresses children's personal information specifically, it governs; for all other data practices, please refer to our general Privacy Policy.

Hubblefamilycare.com ("Website", "Site") is owned by Hubble Family Care (HK) Limited. The provision of the products and customer support services are operated by Hubble Family Care (HK) Limited, a company registered in Hong Kong with its registered office at Unit 1802 18/F, Nan Fung Commercial Centre, 19 Lam Lok Street, Kowloon Bay, Hong Kong.

Hubble Family Care (HK) Limited and its affiliates ("we", "us" or "our") are committed to protecting the privacy of children under the age of 13 who use our hosted websites, software, technologies, services, connected devices, and mobile applications (collectively, the "Services").

Most of our websites, products, and services are primarily designed for adults, and we refer to these as "general interest applications." However, certain products — including connected devices such as Bear — are designed to be used directly by children, with the involvement and consent of a parent or legal guardian. This Children's Privacy Policy applies specifically to those products and describes how we collect, use, and disclose personal information from and about children in that context.

Terms with an initial capital letter have the meanings defined here, whether used in the singular or plural.

Why is there a separate Children's Privacy Policy?

The U.S. Federal Trade Commission's Children's Online Privacy Protection Act ("COPPA") requires us to inform parents about how we collect, use, and disclose personal information from children under 13 years of age, and to obtain verifiable parental consent before doing so.

This Children's Privacy Policy supplements the Hubble Family Care Privacy Policy by providing additional information about how we process children's personal data in connection with our children's connected devices, including Bear.

Where there is a conflict between this Children's Privacy Policy and the Hubble Family Care Privacy Policy, this Children's Privacy Policy governs how we treat children's personal data, consistent with applicable law.

What kind of personal information is covered by COPPA?

Under COPPA, "Personal Information" means individually identifiable information about a child, including: full name (first and last); a home or other physical address, including street name and city or town; online contact information such as an email address or screen name; a telephone number; a Social Security number; a photograph, video, or audio file containing a child's voice; a persistent identifier that can be used to recognize a child over time and across different websites or online services; geolocation information sufficient to identify street name and city or town; or any information collected that is combined with any of the above.

Products directed to children

A Connected Device is designed for children, generally intended for ages 2–8. It allows a child to receive and send voice messages to a parent through the associated app, exchange messages with other approved Connected Devices ("device-to-device Chat"), listen to preloaded stories, lullabies, and educational content, and follow parent-configured routines. Using these features requires a parent to first set up an account and provide consent as described below.

Parental consent

Before you can register a Connected Device to your account, we present a consent form describing what personal information will be collected from your child and how it will be used. We verify that you are an adult and that you are the parent or legal guardian providing this consent through Kids Web Services ("KWS"), a third-party identity and parental consent verification service. Only once this consent form has been completed and your identity has been verified through KWS can you register the device and begin using the connected features of the Services.

You may withdraw your consent at any time by removing the device from your account, as described in "Parents Control Their Children's Information" below. Once a device is removed, we will stop further collection of your child's personal information through that device and will delete previously collected information as described in "How Long We Keep Children's Information," unless we are permitted or required to retain it.

We do not require a child to disclose more personal information than is reasonably necessary to use the Services, and we do not condition a child's participation in any activity on providing more information than is reasonably necessary.

Information we collect from your child

When a parent sets up and enables features of a connected device such as Bear, we collect the following categories of information directly from, or about, the child using the device:

Voice and audio information. We collect your child's voice recordings when they use ConnectChat, Device-to-Device Chat, or other voice-based features, in order to deliver and store messages and to provide the Services. These recordings are stored in your account and may be accessed by the parent through the app.

Location information. We collect approximate location information (such as that derived from IP address) when your child's device is in use, primarily to support device functionality and security.

Persistent identifiers and usage information. We automatically collect certain technical information about how the device and app are used, such as device identifiers, in order to operate, secure, and improve the Services.

Information your child can share, and who we disclose it to

Through ConnectChat, your child can send and receive voice messages with you, as the registered parent on the account. Through Device-to-Device Chat, your child can exchange voice messages with other children's connected devices, but only where the parent of each account has added the other as an approved contact. We do not allow your child to communicate with any contact that has not been approved by a parent, and we do not make your child's information available on any open or public platform.

We may also disclose children's personal information to service providers who help us operate the Services (such as cloud hosting and data storage providers), where required by law or legal process, or as necessary to protect the safety of a child or others. We do not sell children's personal information, and we do not use it to serve targeted or behavioral advertising to children.

How long we keep children's information

We retain children's personal information, including voice recordings and location information, only for as long as reasonably necessary to provide the Services or as instructed by the parent. A parent may request earlier deletion at any time as described below. Where we are permitted or required to retain certain information for a longer period (for example, for security, fraud prevention, or legal compliance), we retain only what is necessary for that purpose and delete it using reasonable procedures once it is no longer needed.

How we protect children's information

We use administrative, technical, and physical safeguards designed to protect children's personal information, including encryption of voice communications in transit, access controls limiting who within our organization can access children's data, and hosting on secured Cloud servers. No method of transmission or storage is completely secure, but we review and update our safeguards as appropriate.

Parents control their children's information

A parent who has given us permission to collect and use their child's personal information can, at any time:

We will verify that the person making the request is the child's parent before acting on it, using the same or a comparable method used to verify consent. We will respond to verified requests within 30 days. Please note that if a parent asks us to delete their child's personal information, this may limit or disable certain features of the connected device that rely on that information (for example, ConnectChat or Device-to-Device Chat), and any active subscription linked to the account is not automatically canceled by this request.

Use of information we collect

We use children's personal information only to provide, maintain, and secure the Services requested by the parent — for example, to deliver voice messages, enable device-to-device Chat between parent-approved contacts, and operate parent-configured routines. Please refer to the "Use of Your Personal Data" section of our general Privacy Policy for more detail, or contact us using the information below.

International users

If you are located outside the United States, additional or different requirements may apply to our processing of your child's personal information — for example, under the EU or UK General Data Protection Regulation. Please refer to our general Privacy Policy for information about those rights, or contact us with any questions.

Changes to this Children's Privacy Policy

We may update this Children's Privacy Policy from time to time. If we make material changes to how we collect, use, or disclose children's personal information, we will notify parents by email and/or a prominent notice on our Services prior to the change taking effect, and we will update the "Last Updated" date above. We encourage you to review this policy periodically.
